We at topmarks.in (“TopMarks”, “our”, “we”, “us”) respect your privacy and want you to understand how we collect, use, and share personal information about you. This Privacy Policy is applicable when you visit and use the TopMarks website. By using the resources of the website either through personal computers or mobiles and other handheld devices, you signify that you have read, understood, and agreed to be bound by this Privacy Policy.

1. What Data we collect

  1. Account Data: We collect personal information that you provide to us when you sign up to create a user account, to access and use the Site or Services, when you consult with customer support or send us an email or communicate with us in any way (for example, to make a support request) or you make a purchase on our Site. Your personal information we collect may include: your contact information (such as your name, address, email address, password, gender, location, academic class or qualification, telephone number); and if you make a purchase, payment details (card information, alternative payment method information, invoices, order information and transaction history), TopMarks does not collect or store sensitive card holder data. If you communicate directly with us, we may maintain a record of those communications and responses, we use this data to respond to you and research your question or concern, in accordance with this Privacy Policy.

Profile Data: You can also choose to provide profile information like a photo, name, class details for learners, academic qualification and experience details for Instructors, website link, or other data. Your Profile Data will be publicly viewable by others. If you choose to create an account with us you will also be asked to create a username, which will be assigned as a unique identifier to your profile. Please be aware that we cannot ensure your privacy when posting content online and we have no control over how other users use the information you make public.
  3. Location Information: We collect information about your general location (country, city) using different types of technologies. We also collect IP addresses and device identifiers that may provide location information.
  4. Shared Content Data: Parts of the Services let you post reviews on an Instructor Course. Such shared content may be publicly viewed and shared by others.
  5. Information collected from Other Sources: In order to enhance the Services provided to you and increase our ability to identify suitable Instructors for our Site, we may obtain information about you from other sources, such as public databases and other sources.
  6. Transaction Data: When you engage in transactions with us, we create records of goods or services purchased, as well as purchasing or consuming histories or tendencies. We use this information to measure the effectiveness of our Services.
  7. Education and Interest information: We do ask for academic information like Academic Board, Class, Medium of Instruction; also, skill levels and interests for Art & Craft courses may be collected.

2. What is this Data used for?

a. To processyour requests and orders for courses, products, service requests, information, or features.

b. To communicate with the user regarding account details, including:

 
  • Answering to your questions and concerns.
  • Sending you administrative messages like invoices, information regarding our Services or Sites, and changes to our terms, conditions, and policies.
  • Sending you information regarding new services, new features, promotions, and inclusion of new courses.

3. How is this Data shared?

We may share your data with third parties as detailed in the points below or as otherwise described in this Privacy Policy.

  1. With your Course Instructors: We share data that we have about you, like your city, country, class, educational board, your preferences in Art & Craft and your activities on TopMarks like course reviews given by you. Your preferences for reference books may also be shared with the Instructors. All this is to help them to tailor and improve their courses to meet your expectations. Under no circumstances will your email address or phone number be shared with the Instructors.
  2. With other Students or Instructors: For Student users, the reviews left by them for subscribed courses will be publicly viewable to other Students and Instructors. For all Instructors in TopMarks, their profile details including name, qualification, location, experience details are publicly viewable to all Students and other Instructors.
  3. Service Providers: In order to provide our Services to you, it is necessary for us to disclose your information to service providers and support who perform certain functions of our Services on our behalf. This include cloud hosting providers (to provide data storage and processing services); communications providers (to process new queries and to manage our emails and SMS).
  4. Payment Processors: When you make a purchase with us, only your card details along with your name, email id & phone number, country of residence are shared with our payment processor partner. We never receive or store your full card information.
  5. Links: We may present links to the user to third party Sites (for example to get the details and purchase books referred in an Instructor’s Course). Clicking on the links in our Site may take you to sites outside our domain. Your data will then be subject to the Privacy Policies and other agreements of that third party.
  6. To Support Social Media Features: When you are visiting the linked social media sites from TopMarks and use the features therein (like clicking the Facebook Like button); this may allow the third-party social media provider to collect information like your IP address etc and to set a cookie to enable the feature. Your interactions with these features are governed by the third-parties privacy policy.
  7. For Security and Legal Compliance: We may disclose information where we are legally required to do so in order to comply with applicable law; Requested as part of a judicial, governmental, or legal inquiry, court order, or proceeding; reasonably necessary to enforce our Terms of Use, Privacy Policy, and other legal agreements; Required to detect, prevent, or address fraud, abuse, misuse, potential violations of law (or rule or regulation), or security or technical issues; or Reasonably necessary in our discretion to protect against imminent harm to the rights, property, or safety of TopMarks, our users, employees, members of the public, or our Services.   8. With Your Consent: with your permission, we may share data to third parties outside the scope of this Privacy Policy.

4. Keeping Your Personal Data Secure:

You can access and update your personal data that TopMarks collects and maintains as follows: To update your personal data, log into your account and update your account at any time; To terminate your account, please mail us at support@topmarks.in from your registered email address and we will do the needful, please note, even after your account is terminated, some or all of your data may still be visible to others, including without limitation any data that has been (a) copied, stored, or disseminated by other users (including in course review comments); (b) shared or disseminated by you or others (including in your shared content); or (c) posted to a third-party platform. Even after your account is terminated, we retain your data for as long as we have a legitimate and legal purpose to do so (and in accordance with applicable law), including to assist with legal obligations, resolve disputes, and enforce our agreements. We may retain and disclose such data pursuant to this Privacy Policy after your account has been terminated. Please note that we retain certain data where we have a lawful basis to do so, including for mandatory record-keeping and to complete transactions. We recognize the privacy interests of children and encourage parents and guardians to take an active role in their children’s online activities and interests.

5. Security from Unauthorized Access:

We at TopMarks take the utmost measures to ensure that your personal details and usage patterns are safe with us; however, no data transmission over the Internet or information storage technology can be guaranteed to be 100% secure. We have implemented appropriate physical, technical and administrative safeguards against unauthorized access, use, alteration and disclosure or destruction of personal information in our custody and control.

There is no third-party access to your personal data in our Services. Since your password is an integral part of the information required to keep your data safe, it is in your interest to keep it secure and maintain a strong password.

The Site and Services that are provided are hosted in India. If you are using the Site or Services from outside India, please be aware that your information may be transferred to, stored, and processed by us in our facilities and by other entities and service providers with whom we share your personal information in India, including entities to process transactions, facilitate payments, and provide support services.
