TopMarks, having the website, www.topmarks.in, was founded with the sole mission to provide learners with an access to the vast knowledge base of qualified instructors both in the fields of academic courses and Art & Craft pursuits. We encourage and provide a platform to anyone anywhere to create and share educational and Art & Craft Courses (Instructors); and to enrol in these courses to learn and improve (students). We consider our marketplace model as one of the best ways to offer valuable educational content to our users. But we require rules to keep our platform and services safe for you, us and our student and instructor community. These Terms apply to all your activities on the TopMarks website, the TopMarks mobile applications and other related services (“Services”).

When you publish a course on the TopMarks platform, you must also agree to the Instructor Terms. We also provide details regarding our processing of personal data of our students and instructors in our Privacy Policy.

These Terms constitute an electronic record in accordance with the provisions of the Information Technology Act, 2000 and the Information Technology (Intermediaries guidelines) Rules, 2011 thereunder, as amended from time to time.

1. Account and Contact Information

Some sections of our Site or Services can be accessed or browsed with creating an account. However, to access all the features you need to register with us and create an account, including to purchase and enrol in a course or to submit a course review. But if you are browsing the Sites or Services and have not yet registered with us, your use of the Site or Services will still be subject to these Terms. When setting up and maintaining your account, you must provide and continue to provide accurate and complete information, including a valid email address and an optional phone number. You have sole responsibility for your account information and the security of your account, including any harm or damage (to us or anyone else) caused by someone using your account without your permission. In this regard you need to be careful with your password. You may not transfer your account to someone else or use someone else’s account. If you contact us to request access to an account, we will not grant you such access unless you can provide us with the information that we need to prove you are the owner of that account. In the event of the unfortunate death of a user, the account of that user will be closed and not operational.

You may not share your account login credentials with anyone else. You are responsible for what happens with your account. You must notify us immediately upon learning that someone else may be using your account without your permission (or if you suspect any other breach of security) by contacting our Support Team at support@topmarks.in. We may request some information from you to validate the ownership of your account.

Students of all age can create an account in TopMarks and access our Site and Services. But for minor students we encourage you to invite a parent or guardian to open an account and help you enrol in courses that are appropriate for you.

You can terminate your account at any time by sending us a request to delete your account at support@topmarks.in. Please check our Privacy Policy to see what happens when you terminate your account.

2. Course Enrolment and Lifetime Access

TopMarks grants you (as a user) a limited, non-exclusive, non-transferable license to access and view the courses and associated content for which you have paid all required fees, solely for your personal, non-commercial, educational purposes through the Services, in accordance with these Terms and any conditions or restrictions associated with a particular courses or feature of our Services. All other uses are expressly prohibited. You may not illegally download, reproduce, redistribute, transmit, assign, sell, broadcast, rent, share, lend, modify, adapt, edit, create derivative works of, sublicense, or otherwise transfer or use any course or content unless we give you explicit permission to do so in a written agreement signed by a TopMarks authorized representative. Sharing our courses in torrent sites are strictly forbidden and punishable under law.

All our enrolled courses have generally a lifetime access license to our registered users. However, we reserve the right to revoke any license to access and use courses at any point in time in the event where we decide or are obligated to disable access to a course due to legal or policy reasons, for example, if the course you enrolled in is the object of a copyright complaint, or if we determine its content violates our Trust & Safety Guidelines.

Instructors are not permitted to grant licenses to their courses and other content to students directly, and any such direct license shall be null and void and a violation of these Terms.

3. Payments, Credits, and Refunds

a. Payments:

You agree to pay the fees for courses and patterns that you purchase, and you authorize us to charge your debit or credit card or process other valid means of payment (such as mobile wallet, UPI or others) for those fees. You agree that you are the authorized user of the payment card, PIN, key, account or other payment method. TopMarks works with third party payment processing partners to offer you the most convenient payment methods in your country of residence and to keep your payment information secure. Please refer to our Privacy Policy for more details.

When you make a purchase, you agree not to use an invalid or unauthorized payment method.

If there are insufficient funds in your account for a purchase your payment will be declined, and if any amount is charged to you will be refunded within the seven working (7) days.

If your payment method fails and you still get access to a course you have enrolled to, you agree to pay us the corresponding fees within fifteen (15) days of notification from us. We reserve the right to disable access to any course for which we have not received adequate payment at any time at our discretion.

b. Cancellation & Refunds

If the course you have purchased is not to your satisfaction, you can cancel and request a refund within seven (7) days from the date of your purchase based on the course type as described below:

Only Class Courses and Art & Craft Courses are eligible for refund.
Art & Craft Patterns are not eligible for refund as it contains a downloadable digital content.

Upon cancellation TopMarks will issue a full refund to your original mode of payment. Under no circumstance will you be issued a refund to any other payment mode of your choice including cash bills. The exact timelines of the refund to be credited to your account will depend on the capabilities of our payments processing partners and your bank. No refund is due to you if you request it after the 7 day trial time limit has passed. However, if a course you previously purchased is disabled for legal or policy reasons, you are entitled to a refund beyond this 7-day limit. TopMarks also reserves the right to refund students beyond the 7-day limit in cases of suspected or confirmed account fraud. For multiple courses purchased in an order individual course needs to be cancelled separately within the 7 day trial period.

If at our discretion, if we believe you are abusing our refund policy, such as if you’ve covered a significant portion of a course that you want to refund or if you are frequently purchasing and then cancelling the courses previously refunded, we reserve the right to deny your refund, ban your account, and/or restrict all future use of our Services. If we ban your account or disable your access to a course due to your violation of our ‘Terms of Use’, you will not be eligible to receive a refund.

c. Your Use of the Site and Services

Rules of Conduct:

You may not access or use the Site and Services or create an account for unlawful purposes. Your use of the Site & Services and behaviour on our platform must comply with applicable local or national laws or regulations of your country of residence. You are solely responsible for the knowledge of and compliance with such laws and regulations that are applicable to you.

If you are a student, the Services enable you to post reviews of courses and patterns. Please don’t post or submit anything that is not yours. The Service is designed for you to only post review comments to Instructor courses and patterns. Do not use this service to communicate with other members or visitors to the site. You agree that all such comments you submit, post, through the Services will comply with these Terms and with the Rules of Conduct set forth herein. Multiple reviews from a single source is strictly not allowed, nor is submitting review for monetary benefits. Malicious or negative course reviews regarding technical issues beyond the Instructors control will be taken down. You acknowledge and agree that when you post the content is available to the public and that you have no expectation of privacy concerning your content. As a result, please exercise caution when posting any personal information in our comment/reviews as it may be as it may be seen and used by others. TopMarks has no obligation to monitor your comments but reserves the right to review and remove it at any time, without notice, for any reason and in its sole discretion. TopMarks is in no way responsible for any user’s misuse of misappropriation of any user content or information that you post on the Site or through the Services.

If you are an instructor, we will help you to submit courses and other content for publication on the platform for learners to enrol and view. But you are not allowed to communicate with the students who have enrolled in your courses through our Services. In all cases, you must abide by the law and respect the rights of others: you cannot post any course, question, answer, review or other content that violates applicable local or national laws or regulations of your country. You are solely responsible for any courses, content, recommended educational books and materials, and actions you post or take via the Site and Services and their consequences. Make sure you understand all the copyright restrictions set forth in the Instructor Terms before you ready to publish a course on TopMarks.

If we notice that your course or content violates the law or the rights of others (for example, it violates intellectual property or image rights of others, or is about an illegal activity), if we discover that your content or behaviour violates our Trust & Safety Guidelines, or if we believe your content or behaviour is unlawful, inappropriate, or objectionable (for example if you impersonate someone else), we may remove your content from our Site. TopMarks complies with existing copyright laws.

TopMarks has discretion in enforcing these Terms and our Trust & Safety Guidelines. We may terminate or suspend your permission to use our Site and Services or ban your account at any time, with or without notice, for any or no reason, including for any violation of these Terms, upon the request of law enforcement or government agencies, for extended periods of inactivity, for unexpected technical issues or problems, or if we suspect that you engage in fraudulent or illegal activities, or for any other reason in our sole discretion. Upon any such termination we may delete your account and content, and we may prevent you from further access to the Site and use of our Services. Your content may still be available on the platforms even if your account is terminated or suspended. You agree that we will have no liability to you or any third party for termination of your account, removal of your content, or blocking of your access to our Site and Services.

If any of our Instructors has published a course that infringes your copyright or trademark rights, please inform at support@topmarks.in with the details. Our Instructor Terms require our instructors to follow the law and respect the intellectual property rights of others. For more details on how to file a copyright or trademark infringement claim with us, please check our Intellectual Property Policy.

In connection with your use of the Sites and Services, you will not harass others or disclose personal information about others that could amount to harassment, impersonate others or create false accounts; publish, post, upload, store, distribute or disseminate any unlawful, defamatory, infringing, obscene, sexually explicit, harmful, confidential, libellous, hateful, threatening or otherwise illegal material or information, or anything which might constitute a criminal or civil offence;

Monitoring: TopMarks reserves the right to monitor all network traffic to the Sites or Services and anyone using the Sites or Services expressly acknowledges that such monitoring may occur. TopMarks may block unauthorized attempts or intrusions to upload or change information or cause damage to the Sites or Services in any fashion. You acknowledge that TopMarks has no general obligation to monitor User Content nor to actively seek facts or circumstances indicating illegal activity, but has the right to review, disable access to, or to edit any User Content in order to: (i) operate, secure and improve the security of the Sites or Services (including without limitation for fraud prevention, risk assessment, investigation and customer support purposes); (ii) ensure compliance with these Terms; (iii) comply with Applicable Laws or the order or requirement of a court, law enforcement, or other administration agency or governmental body; (iv) respond to User Content or conduct that it determines is harmful or objectionable; or (v) as otherwise set forth in these Terms.

Objectionable Content: If you encounter something you find objectionable and in violation of these Terms, you can report it to support@topmarks.in. If we come across such matter, we will delete it without any intimation.

Data Collection and Use: No party unaffiliated with TopMarks may collect or use, or direct, authorize or assist other persons or entities to collect or use any data from a user, or a computer or device operated by a user, while accessing our Site or Services without our prior express written permission.

4. TopMarks Rights to User Content

By submitting or posting content on or through our Site or Services, you grant us a worldwide, non-exclusive, royalty-free license (with the right to sublicense) to use, copy, reproduce, process, adapt, modify, publish, transmit, display, and distribute your content (including your name and image) in any and all media or distribution methods (existing now or later developed). This includes making your content available to other companies, organizations, or individuals who partner with TopMarks for the syndication, distribution, or publication of content on other media, as well as using your content for marketing purposes. You also waive any rights of privacy, publicity, or other rights of a similar nature applicable to all these uses, to the extent permissible under applicable law. You represent and warrant that you have all the rights, power, and authority necessary to authorize us to use any content that you submit. You also agree to all such uses of your content with no compensation paid to you.

5. Using TopMarks at Your Own Risk

TopMarks is a marketplace for Academic and Art & Craft Courses. Our Site & Services do not review or edit the courses that are submitted by the Instructor. So, we are not in a position to validate the legality of the course content. We do not exercise any editorial control over the courses that are available on the Site and, as such, do not guarantee in any manner the reliability, validity, accuracy, or truthfulness of the courses. If you enrol in a course, you rely on any information provided by an instructor at your own risk.

When you post a review in the Site please make sure that no personal information is shared therein, directly with a student or an instructor, you must be careful about the types of personal information that you share, this is for your own safety.

We do not hire or employ instructors. We are not responsible or liable for any interactions involved between instructors and students. We are not liable for disputes, claims, losses, injuries, or damage of any kind that might arise out of or relate to the conduct of instructors or students.

When you use our Site & Services, you will find links to other websites that we don’t own or control. We are not responsible for the content, purchases you make therein, or any other aspect of these third-party sites, including their collection of information about you. You should also read their terms and conditions and privacy policies.

6. TopMarks’s Rights

The Sites and Services, and all content published on or accessible through the Sites and Services, is owned by TopMarks, its affiliates or its licensors, and is protected by laws governing copyrights patents, trademarks, trade secrets and/or other proprietary rights, both in India and abroad. All rights, title, and interest in and to the TopMarks Site and Services, including our website, our existing or future applications and features, databases, and the content our employees or partners submit or provide through our Services (but excluding content provided by Instructors and Students) are and will remain the exclusive property of TopMarks and its licensors. You acknowledge that you do not acquire any ownership rights in any content downloaded or accessed from the Sites or Services. Nothing gives you a right to use the TopMarks name or any of the TopMarks trademarks, logos, domain names, and other distinctive brand features. Any feedback, comments, or suggestions you may provide regarding TopMarks or the Services is entirely voluntary, and we will be free to use such feedback, comments, or suggestions as we see fit and without any obligation to you.

You may not do any of the following while accessing or using the TopMarks Site and Services:

Access, tamper with, or use areas of the Site not for public access (including content storage), TopMarks’s computer systems, or the technical system of TopMarks’s service providers.
Disable, interfere with, or try to circumvent any of the features of the Site related to security or probe, scan, or test the vulnerability of any of our systems.
Copy, modify, reproduce, publish, transmit, distribute, perform, sell, create a derivative work of, reverse engineer, reverse assemble, or otherwise attempt to discover any source code of or content on the TopMarks Site or Services.
Access or search or attempt to access or search our Site or Services by any means (automated or otherwise) other than through our currently available search functionalities if provided via our website. You may not scrape, spider, use a robot, or use other automated means of any kind to access the Site or Services.
In any way use the Services to send altered, deceptive, or false source-identifying information (such as sending email communications falsely appearing as from TopMarks); or interfere with, or disrupt, (or attempt to do so), the access of any user, host, or network, including, without limitation, sending a virus, overloading, flooding, spamming, breaching the firewall, or mail-bombing the platforms or services, or in any other manner interfering with or creating an undue burden on the Services.
Making available any content that is misleading, unlawful, harmful, threatening, abusive, tortious, defamatory, libellous, vulgar, obscene, child-pornographic, lewd, lascivious, profane, invasive of another's privacy, hateful, or racially, ethnically or otherwise objectionable.
Stalking, intimidating and/or harassing another and/or inciting other to commit violence.
Transmitting material that encourages anyone to commit a criminal offence, that results in civil liability or otherwise breaches any relevant laws, regulations or code of practice.
Impersonate any person or entity, or falsely state or otherwise misrepresent Your affiliation with a person or entity.
Interfere with, or inhibit any user from using and enjoying access to the Application/Website/ Services/Products, or other affiliated sites, or engage in disruptive attacks such as denial of service attack on the Application/Website/Services/Products
Use the Services for purposes that are not permitted by: (i) these Terms; and (ii) any applicable law, regulation or generally accepted practices or guidelines in the relevant jurisdiction.

7. TopMarks Legal Terms

You agree that by registering, accessing, or using our Services, you are agreeing to enter into a legally binding contract with TopMarks. If you do not agree to these Terms, do not register, access, or otherwise use any of our Services.

If you are an instructor accepting these Terms and using our Services on behalf of a company, organization, government, or other legal entity, you represent and warrant that you are authorized to do so.

Nothing in these Terms confers any right, benefit, or remedy on any third-party person or entity. You agree that your account is non-transferable and that all rights to your account and other rights under these Terms terminate upon your death.

8. Disclaimer:

The Services and their content are provided on an “as is” and “as available” basis. We make no representations or warranties about the suitability, reliability, availability, timeliness, security, lack of errors, or accuracy of the Services or their content, and expressly disclaim any warranties or conditions (express or implied), including implied warranties of merchantability, fitness for a particular purpose, title, and non-infringement. We make no warranty that you will obtain specific results from use of the Services. Your use of the Services (including any content) is entirely at your own risk.

We are not responsible for delay or failure of our performance of any of the Services caused by events beyond our reasonable control, like an act of natural disaster; electrical, internet, telecommunication outage.

9. Dispute Resolution

If there is a dispute, our Support Team is ready to help resolve the issue. If that doesn’t your grievance you can exercise your options in a legal way to get redressal. But you may not bring that claim in another court or participate in a non-individual class action claim against us.

The Terms shall be governed by and construed in accordance with the laws of India, without regard to conflict of law principles. Further, the Terms shall be subject to the exclusive jurisdiction of the competent courts located in Chennai and You hereby accede to and accept the jurisdiction of such courts.

10. Updating These Terms

These terms will be updated from time to time to clarify our practices or to reflect new or different features added. TopMarks reserves the right in its sole discretion to modify and/or make changes to these Terms at any time. Modifications will become effective on the day they are posted unless stated otherwise. You are advised to periodically visit the site to be check the latest Terms.

Your continued use of our Services after changes become effective shall mean that you accept those changes. Any revised Terms shall supersede all previous Terms.

Instructor Terms

When you join TopMarks as an Instructor, either through invitation or through direct expression of interest, you agree to abide by the following Instructor Terms (“Terms”). These Terms are in addition to the general “Terms of Use” that govern your use of our Site and Services.

1. Instructor Responsibilities

After you enrol as an instructor, you are solely responsible for all content that you post, including video lectures, practice tests, resources (including image slides and downloadable course materials), question answers & solutions, course landing page content, and books you refer and announcements. Collectively referred to as “Submitted Content”.

You ensure and warrant that:

You provide accurate and authentic account and profile information; you own or have the necessary licenses, rights, consents, permissions, and authority to authorize TopMarks to use your Submitted Content as specified in these Terms and the Terms of Use; the educational qualifications, credentials and experience that you have cited when joining our Services and which is displayed in your Instructor profile is authentic and accurate; your Submitted Content will not infringe or misappropriate any third party's intellectual property rights or trademarks; and you will ensure a quality of Instruction and Service that matches your credentials and experience.

You ensure and warrant that you will not:

Post or provide any content or information that is false, inappropriate, misleading, offensive, infringing, derogatory, racist, hateful, libellous, sexist, pornographic in any form, relating to or encouraging money laundering or gambling, post or provide any content or information that harms minors in any way; use our Site or Services to post or transmit any unsolicited or unauthorized advertising, promotional materials, junk mail, spam, or any other form of solicitation (commercial or otherwise) to any user using our Site or Services; use the Site or Services for business other than providing tutoring, teaching, and instructional services to users; impersonate another person either another Instructor or user or gain unauthorized access to another person's account, otherwise deceive or mislead others about the origin of the content or information; interfere with or otherwise prevent other Instructors from providing their services or courses both online or through offline methods; or abuse TopMarks’s resources, including support services.

2. License to TopMarks

You grant TopMarks the rights as mentioned in the Terms of Use to offer, market, and otherwise use your Submitted Content, and to sublicense it to students for these purposes directly or through third parties. This includes the right to add captions or otherwise modify content to ensure accessibility; unless otherwise agreed the Instructor will have the right to remove all or any portion of your Submitted Content from the Services at any time. Except as otherwise agreed, TopMarks’s right to sublicense the rights in this section will terminate with respect to new users only 30 days after the Submitted Content's removal. However, (a) rights given to users who have purchased the course before the Submitted Content's removal will continue in accordance with the terms of those licenses (including any grants of lifetime access) and (b) TopMarks’s right to use such Submitted Content for marketing purposes shall survive termination; we may record all or any part of your Submitted Content for quality control and for delivering, marketing, promoting, demonstrating, or operating the Services. You grant TopMarks permission to use your name, image, profile information, voice, in connection with offering, delivering, marketing, promoting, demonstrating, and selling the contents in our Site and Services, your Submitted Content, or TopMarks's content, and you agree to waive any rights of privacy, publicity, or other rights of a similar nature, to the extent permissible under applicable law.

3. Trust & Safety

a. Trust & Safety Policy

You agree to abide by TopMarks’s Trust & Safety policies, and other Course quality standards or policies prescribed by TopMarks from time to time. It is advised that you check the policies from time to time and ensure that you comply with any updates to them. You understand that your use of the Site and Services is subject to TopMarks’s approval, which we may grant or deny at our sole discretion.

We reserve the right to remove any course content or Pattern and suspend and/or ban an Instructors for any reason at any time, without prior notice, including in cases where: an Instructor or course does not comply with our policies or legal terms (including the Terms of Use); a course does not meet our quality standards or has a negative impact on the student experience; an Instructor engages in behaviour that might show TopMarks in a bad light or bring TopMarks into public disrepute, contempt, scandal, abuse TopMarks resources, including support services; an Instructor engages the services of a marketer or other business partner who violates TopMarks policies; or as determined by TopMarks in its sole discretion.

b. Relationship with Co-Instructors and Learners:

Instructors does not have any direct contractual relationship with students or other Instructors, so the only information the Instructor will receive about students or other instructors is what is provided through the Site and Services. You agree that you will not use the data you receive for any purpose other than providing your services to those students on the TopMarks Site and Services, and that you won't solicit additional personal data or store students' or instructors’ personal data outside the TopMarks Site and Services. You will indemnify TopMarks against any claims arising from your use of students' personal data.

c. Anti-Piracy Efforts:

We take the utmost measures to protect your courses from unauthorized use. To enable this protection, you hereby agree to appoint TopMarks as your agent for the purpose of enforcing copyrights for each of your courses, through notice and takedown processes (under the applicable copyright laws) and for other efforts to enforce those rights. You grant TopMarks the primary authority to file notices on your behalf to enforce and protect your copyright interests. In case you wish to revoke the above rights entrusted to us please mail us at suppor@topmarks.in stating the same. Any revocation of rights will be effective 48 hours after we receive the notice.

4. Trademarks

As an Instructor registered with TopMarks you are subject to the requirements below, may use our trademarks only in conditions we authorize you to do so. You must: only use the images of our trademarks that we make available to you; only use our trademarks in connection with the promotion and sale of your TopMarks courses or your participation on TopMarks; and comply immediately when we request that you discontinue its use. You must not: use our trademarks in a misleading way; use our trademarks in a way that implies that we endorse, sponsor, or approve of your courses or Services; use it for your personal promotion or marketing, or use our trademarks in a way that violates applicable law or in connection with an obscene, indecent, or unlawful content.

5. Deleting Your Account

In the case you wish to terminate your account with us, please mail us at support@topmarks.in with your details. We will close your account in the next seven (7) working days and intimate you of the same. Before we delete your account, we will transfer the remaining scheduled payments due to you. Please understand that if students have previously enrolled in your courses, your name, profile details and all your Submitted Content will remain accessible to those students even after your account is deleted.

6. Applicable Legal Terms

a. Updating These Terms:

From time to time, these Terms may be updated to clarify our practices or to reflect new or different practices (such as when we add new features), and TopMarks reserves the right in its sole discretion to modify and/or make changes to these Terms at any time. The updated Terms will become effective on the day they are posted unless stated otherwise. Your continued use of our Site and Services after changes become effective shall mean that you accept those changes. Any revised Terms shall supersede all previous Terms.

b. Relationship Between Us:

You and we agree that no joint venture, partnership, employment, contractor, or agency relationship exists between us.

c. Survival:

The following sections shall survive the expiration or termination of these Terms: Sections 2 (License to TopMarks), 3.b (Relationship with Co-Instructors and Learners), 5 (Deleting Your Account), and 6 (Applicable Legal Terms).

Intellectual Property

TopMarks is an educational marketplace where Instructors create and submit their courses which are then made available in our Site for learners to enrol. Since TopMarks is a marketplace model we do not review or edit the courses for legal reasons, and so we cannot vouch for the legality of course content. But since TopMarks is an open and transparent platform it is easy for users to identify courses which are violating our Terms and Policies and report the same. It is also important for us to ensure that the courses posted by the Instructors do not in any way infringe the intellectual copyright or trademarks of others. As the first measure to ensure the same, we take an undertaking from all Instructors that the educational content submitted by them are original and they have the authority and rights for all the contents of their courses.

Infringing activity is not tolerated on or through our Site and Services.

1. Third-Party Copyright Infringement Reports

The policy at TopMarks is to remove courses and content from our Site and Services which have been reported as copyright infringement in a notice received from the owner of the original content, and subsequently verified by us. For Instructors who are repeated violators of the copyright infringement, it is also our policy to remove all other courses by the same Instructor. We also reserve the right to terminate the Instructor’s account and ban them for using our Site and Services at any time without prior notice for infringement violations.

If you are the owner of the original material which you think has been infringed in any of the course hosted in our Site, please mail us at support@topmarks.in with the course details, including sufficient information for us to locate the reportedly infringing course(s) on the TopMarks site (the URL on our website and the exact name of the course and Instructor); and the nature of infringement which you would like to report. When filing the report please make sure the following points are taken into consideration:

You are the owner or the designated agent of the copyright making the claim
Your copyright claim has to be sufficiently substantiated by you, and you are required to provide a complete representative list of such original material (such as a URL where the material is located). This is to help us review your claim.
Knowingly submitting a false or misleading claim of copyright infringement is illegal and you could be held liable and prosecuted.
There are types of content that are not protected by copyright, like, book titles, and slogans; intangible concepts, like processes, ideas; or facts.

When we receive a copyright violation report and verify it to be valid we will remove it from our Site and Services, we will also send a copy of that report to the instructor who posted the infringed course which was reported.

2. Third-Party Trademark Infringement Reports

The policy at TopMarks is to remove courses from our Site and Services when they are reported as infringing a third-party trademark. We also reserve the right to terminate an Instructor’s account at any time without prior notice when they post in violation of the trademark rights of others.

To file a trademark infringement report please mail us at support@topmarks.in with the details of the violation, including sufficient information for us to locate the material on TopMarks that you believe violates your trademark rights (web addresses/URLs of the allegedly infringing content). Before you submit a trademark infringement report, please note the following important points:

Please share: Your complete your complete contact information (full name, mailing address, and email or phone number). The basis for your claim of trademark rights, including registration number, if applicable.
Your trademark claim has to be sufficiently substantiated for us be able to address it.
A description of how you believe this content infringes your trademark.
If you are not the rights holder, an explanation of your relationship to the rights holder.

We would like to maintain a thriving, safe and transparent marketplace to benefit our community of learners, Instructors and TopMarks team. To maintain this healthy and professional environment we would like you to follow and maintain the following rules and conditions as cited in our Terms of Use. If you come across any violation please bring it our notice by emailing us at support@topmarks.in. We monitor bad behaviour through the learners and instructors who report them by email or flag abuse on the Site at various pages. We also proactively monitor on-site behaviour and contact learners and instructors who we identify as policy violators. First time violators are given a simple warning, but repeated offenders may be banned from using our Site and Services. In which case the offenders account will be permanently deleted, and the objectionable content(s) will be taken down from our Site. We solely reserve the right to identify and bar a learner or Instructor from using our Site & Services for violation anytime, without prior intimation.
